Terms of Service

These Terms cover ordering a custom song from AmoreTune — how orders work, what you get, and what we each agree to.

01 Agreement to These Terms

By visiting AmoreTune, submitting a song quiz, or placing an order, you agree to these Terms of Service. If you don't agree, please don't use the site or place an order.

02 What We Do

AmoreTune writes and records a one-of-a-kind song about a specific person, occasion, or memory, based on the details you give us in our quiz. Songs are written and performed by real musicians and reviewed by a person before they're delivered — we don't hand you a raw machine output and call it done.

03 Placing an Order

When you check out, you're asking us to write and produce a custom song using the details, names, and story you provide. Prices for the base song and any add-ons — rush delivery, extra verse, instrumental version, keepsake card, high-res cover art — are shown to you before you pay. Orders are processed by our payment partner; we don't store your card number.

04 Delivery

Standard delivery is 7 days from when we have everything we need from you. Rush delivery is available as a paid add-on. When your song is ready, we'll email you and set up a private song page where you can listen to and download it.

05 Getting the Details Right

The story in your song comes from what you tell us. Please double-check names, dates, and details before you submit them. If something's misspelled or wrong in what you gave us, let us know as soon as you get your song and we'll make it right.

06 Revisions

If your song isn't quite right, contact us and tell us what's off. We want you to love the song you give — we'll work with you on it.

07 Refunds

Our full refund policy is on the Refund Policy page and is part of these Terms.

08 Wall Art & Physical Products

Some orders include a printed keepsake fulfilled by a third-party print partner. We'll send you a design to approve before anything is printed. Shipping details you provide are passed to our print partner solely to fulfill your order.

09 Ownership & Use of Your Song

Once delivered, your song is yours to keep, share, and enjoy personally — play it at the party, send it to family, post it online. We, and the musicians who made it, retain ownership of the underlying composition and recording, and may use anonymized clips for our own promotional purposes. We won't use the recipient's name or identifying details in our marketing without your OK.

If you share your story, a review, or a testimonial with us, you agree we may use it in our marketing — on our site, in ads, on social media — unless you tell us not to. We won't publish sensitive personal details (health conditions, for example) drawn from your story without your separate, specific OK to use that detail publicly.

10 What You Send Us; Your Responsibility for Content

The story in your song, and anything you upload — photos, names, quotes — comes from you. By submitting it, you confirm that you have the right to share it, including the right to share details about anyone else featured in the song, and that it doesn't infringe anyone's copyright, trademark, or right of publicity, and isn't defamatory, illegal, or hateful. We can decline or cancel any order for content that violates this, with a refund of amounts not yet spent on production.

You agree to indemnify and hold AmoreTune, its owners, and the musicians who work with us harmless from any claim, damage, loss, or expense — including reasonable attorneys' fees — arising from content you submit or from your breach of these Terms.

11 Text & Email Communications; Consent

If you provide a phone number and opt in, you agree that AmoreTune, and vendors sending on our behalf, may contact you by text message — including by automated dialing or messaging technology — at the number you provide, for order updates and, if you separately agree, promotional messages. Consent to receive texts is not a condition of purchase. Message and data rates may apply; frequency varies. Reply STOP to any text to cancel, or HELP for help.

You confirm the phone number you provide is your own, and you'll let us know if it changes — we're not responsible for messages sent to a number you no longer control. Email works the same way: unsubscribe using the link in any marketing email at any time.

12 Third-Party Services

We rely on outside vendors to run parts of this business — payment processing, email and text delivery, and print fulfillment among them. We choose partners we trust, but we're not responsible for outages or errors on their end that are outside our control.

13 No Guarantees Beyond What We Say Here

We work hard to get every song right, but AmoreTune is provided "as is." We don't promise the site or delivery will be uninterrupted or error-free.

14 Limitation of Liability

To the extent allowed by law, AmoreTune's liability for any claim related to your order is limited to the amount you paid us for that order.

15 Time Limit on Claims

Any claim or dispute you have relating to AmoreTune or your order must be filed within one (1) year after it arises, or it's permanently barred, to the extent allowed by law.

16 Dispute Resolution; Binding Arbitration; Class Action Waiver

Please read this section carefully — it affects your legal rights. Most concerns can be resolved by emailing us directly, and we encourage you to try that first.

If a dispute can't be resolved informally within 30 days, you and AmoreTune agree to resolve it through binding, individual arbitration rather than in court, administered by the American Arbitration Association under its Consumer Arbitration Rules — except either of us may bring an individual claim in small claims court instead.

You and AmoreTune each waive the right to a jury trial and to participate in a class action, class arbitration, or representative action. Claims must be brought individually, not combined with anyone else's.

You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms, with your name and a clear statement that you opt out of arbitration. This section is governed by the Federal Arbitration Act.

17 Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules.

18 Changes to These Terms

We may update these Terms from time to time. We'll post the new version here with an updated effective date.
